Applicable Law:

Trademarks are to be registered in accordance with the applicable Jordanian Law No. 33 of 1952.

Definition of the Trademark:

It is a mark used or intended to be used on any relevant commodities to denote that these commodities belong to the owner of the trademark due to their manufacturing or production with the aim of trading.

Procedures for Registration of Trademarks:

  1. Submit an application for registration of trademarks on the prescribed form attached with the following:
    • A copy of the company's certificate of registration if the applicant is a legal personality (body corporate) or a copy of the identity card or the passport if the applicant is an individual.
    • A copy of the proxy if the application is submitted by a registration agent or an attorney provided that the proxy terms are taken into consideration in terms of authentication and translation in case the proxy is in a language other than Arabic.
    • Pay the specified fees at a bank and attach the bank's coupon to the application.
    • The trademark registrar is entitled to ask for any document he deems necessary for registration.
  2. The application form shall be studied in terms of shape and content and then verified to find out if the trademark is identical with another trademark on the trademarks register.
  3. The application may be approved or rejected and in both cases the trademarks registrar notifies in writing the applicant.
  4. In case the application is approved, the trademark shall be published in the trademarks publication and the applicant shall pay the prescribed publication fees.
  5. Any person may object the registration of the trademark within three months as of the date of publication provided that that person pays the prescribed fees.
  6. In case of no objection, the trademarks registrar shall issue the registration certificate for the applicant after he pays the prescribed fees.

Period of Protection:

The duration of protection is seven years renewable and it may be fourteen years after paying the prescribed fees.
The owner of the trademark may carry out any modifications in accordance with the provisions of the law including modification of the trademark, address, name or goods, etc provided that he pays the prescribed fees for modification.
